Mediation Defined: Mediation is an attempt to bring
about a peaceful settlement or compromise between
disputants through the objective intervention of a neutral
party. The American Heritage® Dictionary of the English
Language, (4th Ed., Houghton Mifflin Company, 2004).
Mediator Defined: One that works to effect reconciliation,
settlement, or compromise between parties at variance.
Merriam-Webster's Dictionary of Law© (Merriam-Webster,
Inc., 1996).
How a Mediator is Designated: Since mediation is a
voluntary process, counsel for parties to a dispute agree
upon the particular mediator to use. Judges often include a
Order of Referral to Mediation and include the name of a
mediator if another mediator is not selected by the parties
within a certain amount of time following said order.
Reasons to Mediate: Mediation is extremely important
since it may result in a signed agreement thereby: (1)
reducing the amount of time that the parties need to pursue
their claims in court or other forums; (2) reducing the
amount of legal fees and costs incurred by the parties; (3)
providing certainty to resolution of claims; (4) allowing
confidential and voluntary settlement discussions (except
where permitted or required by law); (5) increasing the
probabilities of settlement; (6) allowing the parties to
evaluate the strengths and weaknesses of their case; (7)
providing a comfortable although structured environment
for settlement discussions; and (8) many other benefits.
