| Applications for Occupancy - Approve or Not to Approve |
| It seems more common than ever that applications for potential purchasers and renters of units are rejected by associations. However, boards of directors should be very careful if they choose to not timely approve such applications. Associations may not reject potential buyers or renters unless there is a valid right for such approval expressly contained within the Declaration. The Declaration will specify the deadline for the Board of Directors to either approve or reject (also sometimes referred to as deny or object) the application and failure to do so may result in the application as "deemed approved". Boards of Directors must not arbitrarily deny applications, may not selectively enforce the rules by singling-out one owner and not others, may not unlawfully discriminate and must otherwise be careful when reviewing applications for purchases and rentals ------------------------------------------------------------------------------------------------------- Call or send an e-mail today for a consultation at (954) 332-2379 and/or Andrew@DemosLaw.com The information contained on this page and within this website is as-is without any warranty and not to be construed as legal advice.
